Terms of Use
This document sets out the terms for using the Khaas Club website and app. By signing up or using our services, you accept these terms and the Privacy Policy. The full, detailed rules are presented when you register in the app.
1. Definitions
- Platform: the Khaas Club website and app.
- Business: a user who creates an advertising campaign.
- Influencer: a content creator who takes part in campaigns.
- Campaign: an offer to collaborate with defined terms, reward and timing.
- Secure account (escrow): the mechanism by which a campaign’s cash amount is held by the platform until delivery of the content is approved.
- Commitment deposit: an amount the influencer pays to join a campaign, returned to them once they have fully met their commitments.
2. Eligibility
- You must be at least 18 years old.
- You must provide accurate, up-to-date information; influencers must complete identity verification and confirm ownership of their page.
- Each person may hold only one account. Accounts may not be transferred or rented to others.
- The platform may reject a membership request without giving a reason, and may restrict or block an account that breaks these terms.
3. The platform’s role
Khaas Club is an intermediary between businesses and influencers and is not itself a party to the collaboration agreement. The parties are responsible for the quality of the content, the accuracy of campaign information and compliance with advertising laws. The platform provides secure payment, identity verification, check-in and arbitration tools to reduce risk.
4. Campaigns and rewards
- A campaign may be cash, barter (goods or services) or mixed.
- For cash campaigns, and the cash portion of mixed campaigns, the amount is held in escrow before the campaign is published.
- For barter campaigns, the business must state a precise description and a realistic approximate value of the reward. Unrealistic valuation will lead to the campaign being rejected.
- The platform fee is shown transparently before payment and is deducted when the amount is released.
5. Commitment deposit
- The influencer pays the commitment deposit when submitting an application. If the business rejects the application, the deposit is refunded in full.
- After the content is delivered and approved, the deposit is returned to the influencer’s wallet.
- If the influencer does not attend on the agreed date, cancels less than 48 hours before the visit, or fails to deliver the content by the deadline, the deposit is forfeited and paid to the business as compensation.
6. Check-in, delivery and approval
- The influencer’s presence is recorded by entering a one-time check-in code.
- The influencer must submit the agreed content, with its insights, in the app within 7 days of the visit at most.
- The business has 7 days to approve the content or reject it with a stated reason and evidence. If it takes no action within this period, the payment is released to the influencer automatically.
- Published content must remain publicly available for at least the period agreed in the campaign.
7. Cancellation
- An influencer may cancel without penalty up to 48 hours before the visit date.
- A business may cancel a campaign before it approves any influencer, and the escrowed amount is returned to its wallet. Cancelling after an influencer has been approved is subject to compensation under the detailed rules in the app.
- A campaign that attracts no influencers within its deadline expires, and its amount is released.
8. Dispute resolution and arbitration
If the business rejects the content, a dispute case is opened. The influencer has 48 hours to respond and provide evidence, and the Khaas Club arbitration team issues a ruling within 72 hours at most. The ruling may be full approval, partial approval or full rejection, and the amount is divided accordingly. By accepting these terms, both parties accept the platform’s arbitration ruling as final within the platform. This does not prevent either party from turning to legal authorities.
9. Prohibited conduct
- Exchanging phone numbers, messenger IDs or payment links in chat in order to collaborate outside the platform (circumventing the platform)
- Using fake followers, likes or statistics; submitting manipulated documents or insights
- Creating duplicate accounts or using someone else’s account
- Publishing content that is unlawful, offensive or misleading to the audience
- Any attempt to disrupt the technical operation of the platform
Violating these rules may result in forfeiture of the deposit, suspension or permanent blocking of the account, and legal action.
10. Wallet and settlement
Released amounts are credited to the user’s wallet and can be withdrawn to the IBAN registered in the user’s own name. Settlement times and the minimum withdrawal amount are announced in the app. A business can withdraw only its unused or refunded amounts.
11. Intellectual property
The Khaas Club name, logo, design and software belong to the platform. Ownership of the content an influencer creates is determined by the campaign agreement between the parties; unless the campaign states otherwise, the business may use the content on its own channels and the influencer retains the right to display it in their portfolio.
12. Limitation of liability
The platform’s services are provided “as is”. Khaas Club is not responsible for the commercial results of campaigns, for users’ behavior outside the platform, or for indirect damages. The platform’s liability for any collaboration is limited to the fee received from that collaboration.
13. Changes and governing law
The platform may update these terms; significant changes will be announced through the app, and continued use means you accept them. These terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai.
